**REDACTED (b)(6), (b)(7)c, (k)(2)** was asked to discuss the share ratio on ET. **REDACTED (b)(6), (b)(7)c, (k)(2)** explained that the ratio was not enforced in the very beginning. After the site had over 50,000 users, members with a share ratio of less that "1" were warned for having a low ratio and then removed if their ratio had not improved. The ratio was based on the size of the files, not on the number of files downloaded. The majority of files transferred via the ET website were movies.  **REDACTED (b)(6), (b)(7)c, (k)(2)** attorney asked for clarification regarding the ratio as to what was considered "providing content", whether it was original content or downloaded content from others. **REDACTED (b)(6), (b)(7)c, (k)(2)** stated that the ratio was based on the total amount of data transferred, either original content or content downloaded from others. A majority of the data was transferred from one member to another and did not represent original content new to the ET website.

**REDACTED (b)(6), (b)(7)c, (k)(2)** identified other administrator nics who were involved with ET:
**REDACTED (b)(6), (b)(7)c, (k)(2)**, and about five others whose names he could not remember.

**REDACTED (b)(6), (b)(7)c, (k)(2)** added that there were restrictions on those who could add original content to ET. The requirements for being an uploader, someone tasked for bringing original content to the organization, included having a fast connection and access to material to seed. **REDACTED (b)(6), (b)(7)c, (k)(2)** was tasked to promote individuals to be uploaders and to monitor the content the uploaders were providing. **REDACTED (b)(6), (b)(7)c, (k)(2)** believes **REDACTED (b)(6), (b)(7)c, (k)(2)** to be approximately 23 years old, and spent about half of his time managing other uploaders. **REDACTED (b)(6), (b)(7)c, (k)(2)** understanding was that all of the administrators and some moderators had the password to the **REDACTED (b)(6), (b)(7)c, (k)(2)** account and would upload under this account. When asked which administrators utilized the **REDACTED (b)(6), (b)(7)c, (k)(2)** account, **REDACTED (b)(6), (b)(7)c, (k)(2)** named **REDACTED (b)(6), (b)(7)c, (k)(2)** and **REDACTED (b)(6), (b)(7)c, (k)(2)**.  **REDACTED (b)(6), (b)(7)c, (k)(2)** and **REDACTED (b)(6), (b)(7)c, (k)(2)** did not have fast enough internet access to upload, therefor they were responsible for doing coding for the website.

**REDACTED (b)(6), (b)(7)c, (k)(2)** estimated that half of the files uploaded under the **REDACTED (b)(6), (b)(7)c, (k)(2)** account were movies. **REDACTED (b)(6), (b)(7)c, (k)(2)** stated that he  was responsible for just ten movies, including Star Wars Episode III (SW3). **REDACTED (b)(6), (b)(7)c, (k)(2)** originally downloaded SW3 from another Bit Torrent (BT) website named "The Pirate Bay".  The last time **REDACTED (b)(6), (b)(7)c, (k)(2)** accessed The Pirate Bay was when he downloaded SW3.  The only other movie **REDACTED (b)(6), (b)(7)c, (k)(2)** remembered uploading was The Hitchhikers Guide to the Galaxy. **REDACTED (b)(6), (b)(7)c, (k)(2)** received around 95% of the content he uploaded from **REDACTED (b)(6), (b)(7)c, (k)(2)**.

**REDACTED (b)(6), (b)(7)c, (k)(2)** was asked how many uploaders there were with ET and  estimated it to be between 30 to 40 at any time, with a max number of 60.  **REDACTED (b)(6), (b)(7)c, (k)(2)** felt that **REDACTED (b)(6), (b)(7)c, (k)(2)** was the top uploader for ET, **REDACTED (b)(6), (b)(7)c, (k)(2)** would be considered to be
